Many people have purchased products only to find out that they are defective, or not exactly what they expected. This is the reason lemon laws were introduced, for consumer protection. Most of the time lemon laws are used regarding the sale of vehicles, new or used, but they are actually used to govern any merchandise that was sold with a warranty. Consumers who have purchased a car that was deemed defective are still entitled to protection under lemon laws even if the dealer had no prior knowledge of the defects. Some states allow consumers filing suit under the lemon laws to be awarded damages to cover legal fees if they win. Some states allow the consumer to be charged the legal fees if the manufacturer or dealer are found to not be accountable. This is designed to keep consumers from bringing frivolous cases against dealers and manufacturers.
Say a person buys a vehicle that is used and it is found to be a lemon. The person may still be entitled to the protection of lemon laws. Two things can occur, the first being the consumer is reimbursed their money if the warranty is still valid. Most warranties from manufacturers will transfer over if the vehicle is sold during the warranty period. This would make the consumer still able to receive a refund of their money if the vehicle is deemed a lemon.
Second thing that can occur is the consumer could still be covered under these laws even without a dealer or manufacturer's warranty. Given the vehicle was found to be previously in a natural disaster, the odometer has been turned back, or it has illegal parts or stolen parts installed on it, or if the dealer knew there was a previous mechanical problem but sold the vehicle anyway.
Ways dealers are getting around the lemon laws are that some vehicles are sold "as is", this is typically the way used vehicles are sold. Vehicles sold as is become the responsibility solely of the consumer once purchase is made. The consumer is then accountable for any defects the vehicle may have.
Lemon laws are commonly used to refer to vehicles, but as mentioned in the beginning they are not the only ones covered by these laws. Many consumer products have warranties, and any item with a warranty is subject to be governed by these same laws. Consumers may still file suits for any of these types of products with warranties. Again each state is different in their laws, and they also differ from the federal guidelines some, so do research to find out what the best fit for your situation.
